These Terms & Conditions (“Terms”) apply to your use of themagicbazaar.com (the “Site”) and any purchases made through it. By using the Site, you agree to these Terms.

1) About us

2) Using the Site

You agree that you will:

  • use the Site lawfully and not misuse it (e.g. hacking, introducing malware, scraping in a way that disrupts services)
  • provide accurate information when creating an account or placing an order
  • keep any account login details secure and notify us if you suspect unauthorised access

We can suspend or restrict access to the Site if we reasonably believe there has been misuse or a security risk.

 

3) Eligibility

To place an order you must be legally capable of entering into a contract. If you are under 18, you should use the Site only with the involvement of a parent/guardian.

 

4) Products and descriptions

We aim to describe products accurately (including photos and descriptions). However:

  • colours may vary depending on your screen/device
  • packaging may change from time to time
  • product availability can change quickly

We reserve the right to update product information and to correct obvious errors.

 

5) Prices and payment

  • Prices are shown on the Site in GBP unless stated otherwise.
  • Delivery charges (if applicable) will be shown at checkout.
  • Payment is taken at the time you place your order, using our payment provider(s).
  • If a pricing error is obvious and unmistakable, we may cancel the order and refund you.

 

6) Placing an order

When you place an order, you are making an offer to buy. A contract is formed when we confirm acceptance (usually by dispatch confirmation email or equivalent confirmation).

We may refuse or cancel an order if:

  • the item is out of stock
  • we suspect fraud or unauthorised activity
  • we identify a pricing or listing error
  • there are delivery restrictions or address issues

If we cancel after payment, you will receive a refund.

 

7) Delivery

Delivery options, costs, and estimated times are shown at checkout.

  • Delivery dates are estimates and not guaranteed.
  • Risk of loss passes to you once the order is delivered to your address (or collected by you).
  • You should check items on delivery and report any issues as soon as reasonably possible.

 

8) Digital products (if applicable)

If you purchase digital content (downloads, video access, memberships):

  • access details will be provided after purchase
  • you must not share, resell, distribute, or upload digital content to others
  • we may suspend access if we detect misuse or sharing

Important (UK consumer rights): by purchasing digital content, you may be asked at checkout to confirm that you want immediate access and acknowledge you may lose your 14-day cancellation right once downloading/streaming begins.

 

9) Returns and refunds (UK consumers)

If you are a UK consumer, you usually have a legal right to cancel most online purchases within 14 days of receiving your goods.

a) Your right to cancel

  • You have 14 days after delivery to cancel, then a further 14 days to return the goods.
  • You are responsible for return postage unless we state otherwise.
  • We will refund the standard delivery cost (if applicable) but not any premium/express upgrade you chose.

b) Condition of returns

Returned goods should be unused and in resaleable condition, with original packaging where possible. You may handle goods only as you would in a shop; if you use them beyond this, we may reduce your refund to reflect loss in value.

c) Exceptions

The 14-day right to cancel typically does not apply to:

  • sealed items that aren’t suitable for return for health protection or hygiene reasons if unsealed after delivery (where applicable)
  • personalised or made-to-order items
  • digital content once download/streaming has started (if you agreed to this at checkout)

d) Faulty or misdescribed items

If goods are faulty, damaged, or not as described, you have legal rights and we will offer an appropriate remedy (repair/replacement/refund as applicable).

To request a return/refund: email info@themagicbazaar.com with your order number, the item(s), and the reason.

 

10) Promotions and discount codes

  • Discount codes are subject to any stated rules (expiry, minimum spend, excluded items).
  • Codes cannot usually be combined unless stated.
  • We may withdraw or amend promotions where reasonably necessary (including due to error or misuse).

 

11) Intellectual property

All content on the Site (text, images, videos, branding, product descriptions, and downloads) is owned by or licensed to us.

You may not copy, reproduce, republish, sell, or exploit any Site content without written permission, except for personal, non-commercial use as needed to use the Site.

 

12) Acceptable use and prohibited activities

You must not:

  • attempt to gain unauthorised access to systems or accounts
  • interfere with the Site (including DDoS, malware, or automated abuse)
  • use the Site to infringe intellectual property rights
  • resell products in a way that breaches these Terms or any stated product restrictions

 

13) Reviews and user content

If you submit reviews, comments, or other content:

  • you confirm it is accurate to the best of your knowledge and not unlawful, abusive, or infringing
  • you grant us a non-exclusive right to use, display, and reproduce it in connection with the Site and our marketing (unless you ask us to remove it)

We may moderate or remove content at our discretion.

 

14) Liability

Nothing in these Terms limits or excludes liability for:

  • death or personal injury caused by negligence
  • fraud or fraudulent misrepresentation
  • any liability that cannot be limited under applicable law

Subject to the above:

  • we are not responsible for losses that were not reasonably foreseeable
  • we are not liable for business losses (loss of profit, revenue, business interruption) if you are acting as a consumer
  • we do not guarantee the Site will be uninterrupted or error-free, though we try to keep it running smoothly

 

15) Events outside our control

We are not responsible for delays or failure to perform caused by events beyond our reasonable control (e.g. courier disruption, severe weather, outages, supplier issues).

 

16) Privacy

Our handling of personal data is explained in our Privacy Policy (available on the Site).

 

17) Changes to these Terms

We may update these Terms from time to time. The Terms in force at the time you place an order will apply to that order. We will post the current version on the Site and update the “Last updated” date.

 

18) Governing law and disputes

These Terms are governed by the laws of England and Wales. If you are a consumer, you can bring legal proceedings in the courts of the part of the UK where you live.
